General Conditions of Rental

1. Definition and subject of the contract

1.1 This rental/booking contract is a distance contract pursuant to art. 50 and following of Legislative Decree 206/2005 («Consumer Code»). The contract is subject to the reservation and rental of movable goods (costumes and/or tuxedos and/or accessories etc. hereinafter «Products») between Atelier Flavia, with registered office in Castello, 6010 30122 Venice, VAT 00903250272 («Atelier Flavia») and the consumer («Customer»).

1.2 The contract is concluded directly through the acceptance by Atelier Flavia of a leasing proposal issued by the customer by telephone or via the Internet, following the invitation to offer content on the website («site») and/or through other rental systems of Atelier Flavia, based on the modalities described in the following articles 3 and 4.

1.3 These general conditions of rental/reservation («General Conditions») and, in particular, the information referred to in art. 52 Legislative Decree 206/2005 of the Consumer Code, as set out in the site, will remain valid and effective until they are modified and/or supplemented by Atelier Flavia. Any changes and/or additions to the general conditions will be effective with effect from the date on which they will be communicated to the public and will apply to rentals made from that date. The latest updated version of the general conditions is the one available on the site.

2. Prices

2.1 The rental prices of the products illustrated on the site and/or through any other rental systems of Atelier Flavia are inclusive of VAT and any other tax. The costs of delivery and withdrawal, where otherwise specified, are excluded from the price of the products.

3. Rental arrangements

3.1 The rental, unless otherwise communicated, will be 1 day.

3.2 The rental period of the product begins on the day of receipt of the goods by the customer, at the place of delivery indicated by the latter.

3.3 The return of the product must be made by the customer within 12 noon the day after the rental.

3.4 If the customer rents a product of the wrong size, no refund or replacement of the product will be provided, unless such products are available. All expenses will be charged to the customer.

3.5 The customer may request to extend the rental by contacting Atelier Flavia directly. The concession of this extension by Atelier Flavia is subject to the absence of new orders by other customers for the same product and for the period required with the extension. If the asset is not available for the period of extension, the customer will be obliged to return it within the terms originally provided. If the dress will not be returned in the agreed terms, the customer must pay a fee per day equal to 50% of the rental price.

4. Payment methods

4.1 To make the reservation effective, the customer must pay a fee of 30% of the total as a deposit, or the full amount.

4.2 The customer will be allowed to choose one of the following payment methods: Bank transfer, credit card, PayPal or any other means of payment from time to time indicated as valid by Atelier Flavia.

4.3 The name and details provided for the reservation must be the same as the person who rents and pays.

4.4 The rental price is based on the information available at the time of booking. Additional supplements may apply at the time of rental.

4.5 As a deposit for the rental, Atelier Flavia may request an amount determined on the basis of the estimated costs of the product, which will be returned at the end of the rental (without prejudice to the customer’s compliance with these terms general).

4.6 Any changes concerning a reservation made will be recalculated on the basis of the availability and the prices valid at the time of change. The price may be greater or less than the original booking.

4.7 There will be no partial or total refund in the event of cancellation of the reservation or rental.

5. Products

5.1 The essential characteristics of the products are presented on the site, within each card relating to the product itself. However, the images and colors of the products may not correspond to the real ones as a result of the Internet browser and the monitor used.

5.2 Most of the products of Atelier Flavia are handmade, some features such as decorations, color and shape may vary from the products on the site. Therefore, being unique and exclusive pieces will not be the same.

6. Availability of products

6.1 Atelier Flavia accepts customer orders within the limits of the quantities of the required products in stock. Therefore, the acceptance by Atelier Flavia of the rental proposal submitted by the customer is subject to the availability in stock of the products themselves. Atelier Flavia undertakes to promptly inform the customer of any unforeseeable depletion of stocks due to excess demand or other causes.

7. Changes upon pickup/delivery

7.1 If the customer at the time of collection and/or delivery wishes to rent another type of product or the same product for a longer period, it may require an availability check and, if necessary, pay an additional amount.

8. Failure to withdraw the goods

8.1 If the customer does not return and/or deliver the product late, Atelier Flavia reserves the right to charge the customer the amount of the rental price for each day of delay and an amount that covers the administration costs and compensates atelier Flavia for the impossibility of complying with the terms of rental with respect to other customers.

9. Early retirement

9.1 It is not possible to make a refund if the product is returned in advance with respect to the agreed date.

9.2 It is not possible to make a refund if the product is rented but not used.

10. Coverage

10.1 The customer agrees to use the product with care, to prevent the occurrence of damage.

10.2 The customer is fully responsible for the product from the moment it was delivered to the address indicated by him or from the time of the collection at Atelier Flavia.

10.3 The rental price includes:
A. Product cleaning;
B. Delivery and withdrawal of the product at the Hotel, accommodation or residence of the customer if located in the city of Venice, unless otherwise agreed.

10.4 The rental price does not include:
A. Exemption from any liability of the customer in the event of damage caused by the product;
B. Exemption from any liability of the customer in case of partial or total theft, or in case of fire of the property;
C. Waiver of any liability of the customer for damage caused by vandalism, such as tears to the fabric, loss of buttons, breaking of feathers, stains resulting from beverages, etc.
D. Exemption from any liability of the customer for damage to the property such as burns, stains requiring special cleaning, etc.

10.5 The customer is not in any case freed for damage caused to the property (estimated from time to time by Atelier Flavia) in cases of wilful intent or gross negligence or misuse of the property.

11. Jurisdiction

11.1 The contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and breach of the contract shall be the jurisdiction of the Forum in which the customer has his residence or domicile, if located in the territory of the Italian State, or the Forum of Venice, if the customer has his or her residence or domicile abroad.

3. How to buy

3.1 In the case of purchase proposals sent through the site, the customer will receive a summary e-mail from Atelier Flavia, with which he will be informed that his purchase proposal is being processed and will be accepted only at the time of payment, except contrary communication transmitted by Atelier Flavia.

4. Payment Methods

4.1 To make the sales contract complete, the customer will have to pay the full amount.

4.3 If the customer buys a product of the wrong size, no refund or replacement of the product will be provided, unless such products are available. All expenses will be charged to the customer.

6. Availability of products

Atelier Flavia undertakes to promptly inform the customer of any unforeseeable depletion of stocks due to excess demand or other causes.

7. Delivery of products

7.1 Atelier Flavia delivers the products to the address indicated by the customer within 30 (thirty) days after the conclusion of the contract.

7.2 Shipments are made in all countries of the world, unless the country of destination is restricted.

7.3 Shipping costs are calculated according to the destination, weight and size of the parcel, type of service chosen. Shipping costs will be calculated once the order has been confirmed.

7.4 Any customs fees will be borne by the customer.

7.5 Atelier Flavia is not responsible for any delay, damage or loss of goods sent by express courier. However, it will be the care of Atelier Flavia to contact the express courier to obtain all the information of the case.

7.6 In case the package is damaged during transport, the customer can accept it with reserve.

7.7 If the products are damaged, the customer must promptly send an e-mail to Atelier Flavia, attaching the necessary documentation (images of the parcel and the damaged products), in order to allow Atelier Flavia to contact the courier.

8. Customer’s obligations

8.1 The customer declares and warrants: to be a consumer as provided for in art. 3 of the Consumer Code; to be an adult; that the data from the same provided for the execution of the contract are correct and truthful.

9. Right of withdrawal

9.1 The customer has the right to withdraw from the contract stipulated, without penalty and without specifying the reason, within 10 days of receipt of the products. The customer may exercise the right of withdrawal, within the aforementioned period, manifestandolo by means of a written notice at the office of Atelier Flavia.

9.2 The customer who intends to avail himself of the right of withdrawal shall return the products to the address indicated on the invoice within 30 days of receipt of the products. Pursuant to article 55, second paragraph, of the Consumer Code, the customer shall not be entitled to withdraw in the case of supply of custom-made or customized products, or which by their very nature, cannot be returned or risk deteriorating or quickly (e.g. cosmetics, flowers, foodstuffs).

9.3 The costs of returning the products and any customs fees will be borne by the customer. Atelier Flavia ensure that the products have been returned complete with all its parts and functionality, which have not been worn, used and that have not been damaged. In this case Atelier Flavia will return, within 60 days from the date of receipt of the products by the customer, the price paid by the customer for the returned products.

10. Jurisdiction

10.1 The contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and breach of the contract shall be the jurisdiction of the Forum in which the customer has his residence or domicile, if located in the territory of the Italian State, or the Forum of Venice, if the Customer has his or her residence or domicile abroad.
